Acceptance of these Terms

These Terms and Conditions ("Terms") are a binding agreement between you and MileMates governing your use of the Platform. By creating an account, ticking the acceptance box, or using the Platform, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) and legally capable of entering into a binding contract to use the Platform. If you are a minor, you may use the Platform only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. One account per person; you must provide accurate information and keep it updated.

Assumption of risk

Physical activity, including running, walking, cycling, hiking and other exercise, carries inherent risks of serious injury, health complications or death. You voluntarily choose to participate and you assume all such risks. You are solely responsible for your own health, fitness, safety, decisions and surroundings. To the maximum extent permitted by law, you release and waive any claims against MileMates arising from your participation in any activity tracked or organised through the Platform.

Not medical advice

The Platform provides fitness tracking, estimates and general guidance (including Recovery Score, pace, calorie and training insights) for informational purposes only. It is not medical, health, nutritional or professional advice and is not a substitute for consultation with a qualified professional. Consult a physician before beginning or changing any exercise or diet program.

MileCoins and virtual items

MileCoins and any in-app points, badges or virtual items are for engagement and motivation only. They have no monetary value, are not your property, cannot be purchased with or redeemed, exchanged or cashed out for real money, and may be modified, reset or removed at any time. Challenges and "bets" are skill-based fitness goal commitments using non-monetary MileCoins and do not constitute betting, gambling, lottery or a game of chance. You are responsible for any taxes that may arise from any reward you receive.

Challenges and fair play

Challenges must be completed with genuine, honestly tracked activities. GPS spoofing, using a vehicle in run or walk challenges, sharing devices, or any manipulation or cheating is prohibited and will result in disqualification, forfeiture of staked MileCoins and possible account suspension or termination.

Clubs, events and real-world meetups

Clubs and events may involve interaction and meetings with other users in the real world. MileMates does not verify the identity, background or conduct of users and is not responsible or liable for the actions, safety, conduct or omissions of any user or club. You participate entirely at your own risk. Always verify who you are meeting, meet first in public, well-lit places, inform someone you trust, and assess routes, timing and safety yourself. Club creators are responsible for their community and must not use clubs for spam, undisclosed commercial promotion, or unlawful purposes.

Coach Booking

MileMates reviews and verifies independent, freelance fitness and diet coaches before assigning them to users based on submitted requests. Coaches are independent third parties and are not employees, agents, or representatives of MileMates. MileMates does not set, control, or process any fees for coaching services - all pricing, payment, and scheduling arrangements are made directly and independently between the user and the assigned coach, outside the Platform. While MileMates takes reasonable steps to verify coach credentials at the time of assignment, MileMates does not guarantee the ongoing conduct, service quality, advice accuracy, or outcomes of any coach, and is not responsible or liable for any dispute, payment issue, dissatisfaction, or injury arising from the coaching or diet-related services provided.

Your content and licence

You retain ownership of content you create, but you grant MileMates a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, display and distribute that content for operating and promoting the Platform, consistent with your privacy settings. You are solely responsible for your content and confirm you have the rights to share it.

Prohibited conduct and community safety

You must not: break any law; post content that is illegal, hateful, harassing, defamatory, obscene, sexually explicit or infringing; impersonate others; stalk, threaten or abuse anyone; share another person location or personal details without consent; spam or scrape the Platform; upload malware; or attempt to disrupt or gain unauthorised access to the Platform. MileMates has zero tolerance for harassment and is committed to user safety, including women safety. We may remove content and suspend or permanently ban accounts that violate these rules, and report unlawful conduct to authorities.

Accuracy of metrics

Distance, pace, elevation, calories, heart rate and other metrics are estimates that depend on your device sensors and GPS quality and may differ from other services or measured courses. You should not rely on them for medical or safety-critical purposes.

Intellectual property

The Platform, including its name, logo, design, software and content (excluding user content), is owned by MileMates and protected by intellectual property laws. You may not copy, modify, distribute, reverse engineer or create derivative works without our written permission.

Third-party services

The Platform may link to or rely on third-party services (such as maps, music controls, sharing or login providers). We are not responsible for third-party services or their content, and your use of them is subject to their own terms.

Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, reliability, or uninterrupted or error-free operation, to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, MileMates and its founders, employees and partners shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any injury, death, loss of data, loss of profits, or damages arising from your use of, or inability to use, the Platform, activities you undertake, interactions with other users, or reliance on any metric or content. Our total aggregate liability, if any, shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim, or INR 1000, whichever is lower.

Indemnification

You agree to indemnify, defend and hold harmless MileMates and its founders, employees and partners from and against any claims, damages, losses, liabilities and expenses (including legal fees) arising from your use of the Platform, your content, your activities or meetups, or your violation of these Terms or any law or third-party rights.

Suspension and termination

We may suspend, limit or terminate your access to the Platform at any time, with or without notice, if you violate these Terms or where we consider it necessary to protect the Platform, users or comply with law. You may stop using and delete your account at any time.

Governing law and disputes

These Terms are governed by the laws of India. You agree that the courts at our principal place of business in India shall have exclusive jurisdiction, subject to any applicable requirement to first attempt resolution through good-faith negotiation or arbitration under the Arbitration and Conciliation Act, 1996.

Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and MileMates regarding the Platform.

Reservation of rights

MileMates reserves the right, at its sole discretion and at any time, to add, change, modify, suspend, restrict or remove any rules, features, functionality, content, challenges, clubs, MileCoins, premium benefits, pricing, limits or any part of the Platform or these Terms, with or without prior notice, and without any liability to you. Where required by law, material changes will be notified in the app. We may also introduce new rules or requirements in the future as needed, and your continued use of the Platform constitutes acceptance of such changes.

Changes to these Terms

We may update or revise these Terms from time to time in our sole discretion. The updated Terms take effect when posted in the app (or on the date stated). Material changes will be announced in the app. Your continued use after changes take effect constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Platform.
